DMCA Copyright Infringement Notice & Takedown Policy

Printler.com complies with the Digital Millennium Copyright Act (DMCA) and similar regulations in other jurisdictions by responding to written notifications of alleged infringement from legitimate copyright holders. As part of our response, we may remove or disable access to allegedly infringing material hosted on Printler.com. Please note that Printler cannot remove content from websites of third-party sellers or customers using our platform. Therefore, if the infringing content resides on a third-party website, we cannot assist in removing it.

1. Notification of Infringement

To submit a DMCA copyright infringement notice to Printler, please use our dedicated DMCA notice form here

You can also file a DMCA notice via e-mail at: dmcanotice@printler.com.  To file a DMCA notice via email, your notice must should include the following information:

  • Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are involved, provide a representative list of such works.

  • Location of the infringing content: Include specific URLs or links to the page(s) on Printler.com where the infringing content is located. If the content is a specific image, provide details of the image or artwork being infringed.

  • Contact information: Provide your full legal name, address, telephone number, and email address to enable us to contact you.

  • Statement of good faith belief: Provide a statement that you believe in good faith that the use of the copyrighted material is not authorized.

  • Statement of accuracy and authority: Provide a statement under penalty of perjury that the information in the notice is accurate, and that you are the copyright holder or that you are authorized to act on behalf of the copyright holder.

  • Signature: The notice must be signed by the copyright holder or an authorized representative. This can be an electronic signature.


Please make sure all required information is provided in order for us to timely process your DMCA notice .

 

Please note that under Section 512(f) of the DMCA and similar regulations, anyone who knowingly misrepresents that material or activity is infringing may be liable for damages and attorneys’ fees incurred by the alleged infringer or by Printler. Therefore, if you are unsure whether material infringes your copyright, we strongly encourage you to consult with an attorney before submitting a DMCA notice.

 


 

2. Printler’s Response to DMCA Notices

Printler will investigate all valid submitted written DMCA notices.  We will expeditiously remove or disable access to any allegedly infringing content hosted on Printler.com, subject to the artist’s right to file a counter-notice (see below).
If you believe that your copyright is being infringed by a Printler user (a seller or customer), we encourage you to contact that user directly. Printler can only remove or disable allegedly infringing content hosted on Printler.com.
We may suspend or terminate access to the Printler website for users who repeatedly infringe copyrights or act in an egregious manner.

 


3. DMCA Counter-Notices

If your content has been removed or disabled due to a DMCA takedown notice, and you believe the removal was a mistake or misidentification, you can submit a counter-notice. Your counter-notice must include the following:

  • Subscriber’s contact information: Provide your full legal name, address, telephone number, and email address.

  • Identification of the material: Clearly identify the content that was removed or to which access was disabled, and the location where the material appeared before it was removed.

  • Jurisdiction consent: A statement consenting to the jurisdiction of the United States District Court for the district where you reside, or if you live outside the United States, where Printler is located, and that you will accept service of process from the person who originally submitted the DMCA notice. 

  • Statement under penalty of perjury: Provide a statement under penalty of perjury stating that you have a good faith belief that the material was removed due to mistake or misidentification.

  • Signature: A physical or electronic signature of the person submitting the counter-notification.

Printler will only accept counter-notifices that meet the above requirements. Upon receipt of a valid counter-notice, Printler will provide the original complainant with a copy of the counter-notice. After 10 business days fo receipt of a valid counter-notice, the material will be restored unless we receive notice that a court action has been filed to prevent you from engaging in the alleged infringement.

4. Repeat Infringer Policy

Printler respects the intellectual property rights of copyright holders. As part of our DMCA compliance, we have a Repeat Infringer Policy. If an artist receives three or more valid DMCA takedown notices, their Printler account may be suspended or permanently disabled.  

This policy is designed to balance the needs of our users with the protection of intellectual property rights, ensuring that users are not unfairly penalized for isolated instances of infringement while also addressing patterns of infringement.

 


 

5. Limitation of Liability

Under the DMCA, Printler.com is not liable for infringing content uploaded by users, as long as the platform complies with the notice-and-takedown process described in this policy. We act promptly upon receiving valid DMCA notices of infringement.

We take the protection of intellectual property seriously and will take appropriate action in response to valid DMCA notices. Because of the artist’s right to provide a counter-notice, we cannot guarantee the removal of allegedly infringing content in all cases.


 

6. Changes to This Policy

Printler.com reserves the right to modify or update this DMCA policy at any time. Any changes will be posted on this page, and the effective date will be updated. It is important for users to review this policy periodically to stay informed about how we handle intellectual property complaints.
